These Terms & Conditions (“Terms”) govern your use of the DeskStreamer website at www.deskstreamer.com (the “Site”) and the DeskStreamer software (the “Software”), each provided by Vivtron (“we”, “us”, “our”). By using the Site or installing the Software, you agree to these Terms. If you do not agree, do not use the Site or Software.

01Use of the Site

The Site is provided for general information about DeskStreamer. You agree to use it only for lawful purposes and not to attempt to disrupt, attack, or gain unauthorised access to the Site or its underlying systems.

02Intellectual property

The Site and the Software, including their text, graphics, logos, the DeskStreamer name and marks, and all software code, are owned by Vivtron or its licensors and are protected by intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, or create derivative works from them.

03Your responsibilities

DeskStreamer is a tool that records screens, and optionally audio and webcam video. You are solely responsible for ensuring that your use of it is lawful in your jurisdiction, including providing any required notices to, and obtaining any required consents from, individuals who may be recorded (for example employees), and complying with applicable privacy, surveillance, employment, and payment-security requirements (such as PCI-DSS where cardholder data may be captured).

04Third-party links

The Site may reference third-party services or sites. We are not responsible for the content or practices of any third party.

05Software License Agreement (EULA)

This section is the end-user license agreement for the Software. It applies in addition to any license text distributed with the Software, which governs in the event of a conflict.

Grant. Subject to these Terms and payment of any applicable fees, Vivtron grants you a non-exclusive, non-transferable, revocable license to install and use the Software on the number of machines covered by your trial or purchased license, solely for your internal business purposes.

06Trial & licensing

• The Software may be evaluated under a time-limited free trial. When the trial period ends, streaming features stop until a valid license key is activated.
• Licenses are issued per machine and activated offline using signed license keys. Multi-seat keys may be issued for fleets.
• License fees, seat counts, and any support terms are as agreed in your order.

07License restrictions

You may not, and may not permit others to: (a) copy, distribute, resell, sublicense, rent, or lease the Software except as expressly permitted; (b) reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits; (c) circumvent, disable, or tamper with the Software’s licensing or security mechanisms; (d) remove or alter any proprietary notices; or (e) use the Software in violation of applicable law.

08Disclaimer of warranties

THE SITE AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Software will be uninterrupted, error-free, or that it will capture or record without loss.

09Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVTRON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR RECORDINGS, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SOFTWARE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SOFTWARE LICENSE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING IT.

10Governing law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws rules. Subject to the paragraph below, the courts at Mumbai, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, the Site, or the Software.

Nothing in this section deprives a customer who deals as a consumer of the protection of any mandatory provisions of the law of their country of residence; where such mandatory local law applies, it prevails to the extent of any conflict.
